Privacy Policy
Personal data (hereinafter mostly referred to simply as “dataâ€Â) is processed by us only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.
Pursuant to Art. 4(1) of Regulation (EU) 2016/679, the General Data Protection Regulation (hereinafter “GDPRâ€Â), “processing†means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
With the following privacy policy, we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we either alone or jointly with others decide on the purposes and means of processing. In addition, we inform you below about third-party components that we use for optimization purposes and to enhance user experience, insofar as third parties process data under their own responsibility.
Our privacy policy is structured as follows:
- I. Information about us as the controller
- II. Rights of users and data subjects
- III. Information on data processing
- IV. Shopify Services (additional notes)
I. Information about us as the controller
The controller within the meaning of data protection law for this website is:
Silvercoin Artworks X e.U.
Engelsdorferstraße 4
3730 Eggenburg
Austria
II. Rights of users and data subjects
With regard to the data processing described in more detail below, users and data subjects have the right:
- to confirmation as to whether data concerning them is being processed, to information about the data processed, to further information about the data processing and to copies of the data (see also Art. 15 GDPR);
- to rectification or completion of inaccurate or incomplete data (see also Art. 16 GDPR);
- to the immediate erasure of data concerning them (see also Art. 17 GDPR), or alternatively, insofar as further processing is required pursuant to Art. 17(3) GDPR, to restriction of processing in accordance with Art. 18 GDPR;
- to receive the data concerning them that they have provided and to have this data transmitted to other controllers (see also Art. 20 GDPR);
- to lodge a complaint with a supervisory authority if they believe that data concerning them is being processed by the provider in breach of data protection regulations (see also Art. 77 GDPR).
In addition, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or erasure of data or restriction of processing that takes place pursuant to Articles 16, 17(1), 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Notwithstanding this, the user has a right to information about these recipients.
Likewise, pursuant to Art. 21 GDPR, users and data subjects have the right to object to the future processing of data concerning them if the data is processed by the provider on the basis of Art. 6(1)(f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.
III. Information on data processing
The data processed when using our website will be deleted or blocked as soon as the purpose for storage no longer applies, provided that no statutory retention obligations prevent deletion and no different information is provided below for individual processing operations.
Cookie Manager
To obtain consent for the use of cookies that are not technically necessary on the website, the provider uses a cookie manager. When the website is accessed, a cookie containing the settings information is stored on the user’s device so that the consent query does not have to be repeated on a subsequent visit. The cookie is required in order to obtain the user’s legally compliant consent. The user can prevent or stop the installation of cookies by adjusting their browser settings.
Cookies
Session cookies
We use so-called cookies on our website. Cookies are small text files or other storage technologies that are placed and stored on your end device by the internet browser you use. Through these cookies, certain information about you is processed to an individual extent, such as your browser or location data or your IP address.
This processing makes our website more user-friendly, effective and secure, as it enables, for example, the display of our website in different languages or the provision of a shopping cart function.
The legal basis for this processing is Art. 6(1)(b) GDPR, insofar as these cookies process data for contract initiation or contract performance. If the processing does not serve contract initiation or contract performance, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6(1)(f) GDPR.
These session cookies are deleted when you close your internet browser.
Third-party cookies
Where applicable, our website may also use cookies from partner companies with whom we work for the purposes of advertising, analysis or the functionality of our website. For details, in particular regarding the purposes and legal bases for processing such third-party cookies, please refer to the information below.
Option to remove cookies
You can prevent or restrict the installation of cookies by adjusting your internet browser settings. You can also delete cookies that have already been saved at any time. The required steps and measures, however, depend on the specific internet browser you use.
In the case of so-called Flash cookies, processing cannot be prevented via the browser settings. Instead, you must change the setting of your Flash player. The steps and measures required for this also depend on the specific Flash player you use.
If you prevent or restrict the installation of cookies, this may mean that not all functions of our website are fully usable.
Contact requests / contact option
If you contact us via contact form or email, the data you provide will be used to process your inquiry. Providing this data is necessary to process and respond to your inquiryâ€â€without it, we cannot respond or can only respond to a limited extent.
The legal basis for this processing is Art. 6(1)(b) GDPR.
Your data will be deleted once your inquiry has been fully answered, provided that no statutory retention obligations prevent deletion, for example in the case of subsequent contract processing.
Newsletter
If you subscribe to a free newsletter, the data requested for this purposeâ€â€your email address as well as, optionally, your name and addressâ€â€will be transmitted to us. At the same time, we store the IP address of the internet connection from which you access our website as well as the date and time of your subscription.
As part of the further registration process, we will obtain your consent to receive the newsletter, describe the content specifically and refer you to this privacy policy. The data collected in this process is used exclusively for sending the newsletterâ€â€therefore, it is not passed on to third parties.
The legal basis is Art. 6(1)(a) GDPR.
You can revoke your consent to receive the newsletter at any time with effect for the future pursuant to Art. 7(3) GDPR. To do so, you simply need to inform us of your revocation or click the unsubscribe link contained in every newsletter.
Server data
For technical reasons, in particular to ensure a secure and stable website, data is transmitted by your internet browser to us or to our web hosting provider. These so-called server log files include, among other things, the type and version of your internet browser, the operating system, the website from which you switched to our website (referrer URL), the website(s) of our website that you visit, the date and time of each access, and the IP address of the internet connection from which you use our website.
This data is stored temporarily, but not together with other data about you.
This storage is based on Art. 6(1)(f) GDPR. Our legitimate interest lies in improving, stabilizing, ensuring the functionality and enhancing the security of our website.
The data will be deleted after no later than seven days, unless further retention is required for evidentiary purposes. Otherwise, the data is wholly or partially exempt from deletion until the incident has been finally clarified.
Contract processing
The data you transmit to make use of our goods and/or services is processed by us for the purpose of contract processing and is required for this purpose. Conclusion and performance of the contract are not possible without providing your data.
The legal basis for processing is Art. 6(1)(b) GDPR.
We delete the data upon complete contract processing, but must observe tax and commercial law retention periods.
As part of contract processing, we pass your data on to the transport company commissioned with delivering the goods or to the financial service provider, insofar as the transfer is necessary for delivery of the goods or for payment purposes. The legal basis for the transfer is then Art. 6(1)(b) GDPR.
